‍CONSENT TO ELECTRONIC COMMUNICATIONS AND RECEIPT OF ELECTRONIC DISCLOSURES (“Consent”)

Please read this information carefully. .By clicking "I Agree" or  other  links  assenting  to  our  terms,  you  consent  to electronic communications and electronic delivery of Documents in the manner set forth in this Consent.

‍Consent and Scope. If you choose to obtain an Eve Financial Credit card, you must consent to do business with Eve Financial and First Pryority Bank electronically. We will provide you with “Documents” in electronic format for viewing on a computer, mobile device or other similar device or ,at our option, via e-mail or in a paper form instead. As used in this Consent, “Documents'' mean the credit card agreement and all other documents we need to provide you under applicable law—such as this Consent, your application for any extension of credit, periodic statements and any related disclosures or documents we are required to provide you in writing under applicable law in connection with any extension of credit, including any notice that we are not approving an application and any other required, written information relating to an extension of credit that you apply for or enter into. You agree that we may send communications to you using the contact information you have given us in order to advise you of upcoming or missed payments, deliver Documents to you (if we choose to) or to provide additional information about any credit agreement or application to you. As a courtesy to you, we will also provide you with the ability to e-mail the card agreement and certain other Documents to yourself when they are presented to you on the device you are using.

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter.

This Consent applies to all Documents. If you do not sign this Consent or you withdraw this Consent before entering into a credit agreement, you will not be able to enter into a card agreement. If you first sign this Consent, enter into a card agreement and then withdraw this Consent, the card agreement will remain in effect. However, any Documents we provide after you withdraw this Consent will be provided to you in paper form subject to any charges for such Documents set forth in the credit card agreement.

‍Option for Paper or Non-Electronic Records; Withdrawal of Consent. You may view Documents and print paper copies of Documents without charge by logging into the Eve Financial credit card mobile app. You may request paper copies of specific Documents without charge by mailing a written request to us to 2701 N. Thanksgiving Way #100, Lehi, Utah 84043. You may withdraw this Consent to receive electronic Documents by writing to us at the addresses set forth in this paragraph. Any withdrawal of this Consent will be effective only after we have a reasonable period of time to process your request. The legal effectiveness, validity, and enforceability of any Documents will not be affected by your withdrawal of this Consent..

Hardware and Software Requirements. To access the Documents, the device you are using must have a widely-used, recent-generation mobile app store (for example, Google Play, Apple App Store). To store or print Documents on your own device, you need to have a printer connected to your device or you need to have a hard drive or disk drive. You promise us that you have the hardware, software and printer or drive described above, and you promise us that the e-mail address you have provided is your correct e-mail address (you also promise to notify us at support@eve.co should you change your e-mail address).
