Electronic Communications Consent

Please read this information carefully. By clicking “I Agree,” checking the box presented with this Consent, or otherwise assenting to our terms, you consent to receive communications and documents from Eve Financial, Inc. electronically as described below.

1. Who this Consent is with

Eve Financial, Inc. (“Eve,” “we,” “us,” or “our”) operates a financing marketplace. When you submit a financing request through Eve, we route that request to third-party lenders who may make you an offer. Eve is not a lender, does not make credit decisions, and does not service loans.

This Consent is between you and Eve, and covers only the documents and communications Eve provides to you. Lenders, merchants, and other third parties provide their own agreements and disclosures under their own terms, and will obtain their own consent to electronic delivery where the law requires it. This Consent does not cover those documents.

Your consent is voluntary. However, because Eve provides Documents electronically, we may be unable to process your financing request if you do not consent.

2. What this Consent covers

This Consent applies to the categories of Documents described above. It is not limited to any single financing request or transaction, and remains in effect for as long as you use Eve unless you withdraw it.

We may provide Documents to you by email, by text message, by posting them to the Eve platform or a website we make available to you, by providing a link to them, or by any other electronic method permitted by law.

3. Electronic signatures

You agree that we may use electronic signatures, and obtain electronic signatures from you, in connection with your use of Eve. When you click a button such as “I Agree,” check a box, type your name, or take a similar action indicating agreement, that action is your electronic signature and has the same legal effect as a handwritten signature on paper. You agree that Documents you sign electronically, and the records we maintain of them, satisfy any requirement that they be in writing.

4. Communications

You agree that we may contact you using the email address, mailing address, and telephone number you provide, including by email, text message, and telephone, for purposes relating to your financing request and your use of Eve. Message and data rates may apply, and message frequency may vary. You may opt out of text messages at any time by replying STOP, or by any other reasonable method that clearly communicates your request. You may text HELP for assistance. Opting out of text messages does not withdraw this Consent.

This Section covers communications relating to your financing request and your use of Eve. It is not consent to receive marketing or promotional calls or text messages. Where we seek your consent to marketing or promotional calls or texts delivered using an automatic telephone dialing system or a prerecorded or artificial voice, we will obtain that consent separately, and it will not be a condition of using Eve or of obtaining financing.

5. Your right to paper copies

You may request a paper copy of any Document at no charge. To request one, email us at support@eve.co or write to us at Eve Financial, Inc., 333 E Main St PO 764, Lehi, UT 84043. Please identify the Document you are requesting.

6. Withdrawing your consent

You may withdraw this Consent at any time, at no charge, by:

• Emailing support@eve.co with the subject line “Withdraw E-Sign Consent”; or
• Writing to Eve Financial, Inc., 333 E Main St PO 764, Lehi, UT 84043.

Your withdrawal takes effect once we have had a reasonable period of time to process your request.

7. Keeping your contact information current

You agree to notify us promptly if your email address, mailing address, or telephone number changes. You may update your information by emailing support@eve.co, by calling (385) 396-5846, or by writing to the address above. You confirm that the email address you have provided is valid and that you are able to receive email at that address. You represent that any email address or telephone number you give us belongs to you, or that you are authorized to receive Documents and communications at it.

8. Hardware and software you will need

To access, view, and retain Documents electronically, you will need:

• A computer or mobile device with internet access
• A current version of a widely used internet browser, such as Google Chrome, Apple Safari, Mozilla Firefox, or Microsoft Edge, that supports at least 128-bit encryption
• A valid email address and software capable of receiving and reading email
• Software capable of viewing and printing PDF files, such as Adobe Acrobat Reader
• Sufficient storage space to save Documents, or a printer capable of printing them

If we change these requirements in a way that creates a material risk that you will not be able to access or retain Documents, we will notify you and allow you to withdraw this Consent without charge.

9. Your confirmation

By consenting, you confirm that you can access and read this Consent electronically, that you have the hardware and software described in Section 8, and that you can retain a copy of this Consent for your records either by printing it or saving it to your device.

10. Changes to this Consent

We may revise this Consent from time to time. Changes take effect when we post the revised Consent with an updated “Last Updated” date. Where the law requires it, we will provide advance notice of material changes and the opportunity to withdraw this Consent.

We may also provide any Document in paper form, or discontinue providing Documents electronically, at our discretion, and will give you notice where the law requires it.
